Have recieved a reply from the land reg people this morning. apparently there is no registered estate, What does this mean ? I only want to know who's name the house is in. |

If you go to www.yell*com (replace the star with a full-stop when you type it in your browser) you can type in look for 'solicitors' in the 'cornwall' area and it comes up with 100 names! Too many for me to list here but if you know the town he lived in then you can narrow it down and get the firms in that region. Good luck! Claire |

Thankyou, I hink I will visit the local CAB office, the trouble is that he lived in Cornwall and we live in the midlands so it is difficult to find out any solicitors in the area that he lived in. Many thanks. Pat |

hiya, i dont know if this will help or not, when my father died in 1988, he left a will, in which he stipulated that under no terms should any of his estate go to his 3 children, he left everything to his present wife and his sister/ her children. my advice would be to ring all solicitors in area and see if there has been a will deposited or read, Contact the CAB, and contact your local probate office, they may be able to help, sorry I cant be of more help Julie |

Thankyou for all the advice, I have waited all this time because he left the area where he was living with his then new wife and didn't leave the the children a forwarding address, We didn't find out where he was living for a long time, by then I had been advised that I would have to claim from his estate when he died. But of course if he has put everything in her name then we don't stand a chance of claiming anything. He didn't have anymore children, just as well as he left me with 4 to bring up on my own. if he jointly owned the house when he died,only half of the house will be considered as his estate for tax purposes,and the first 135K goes to the wife anyway (approx) . After that it can then be divided. Why have you waited this long to claim? |

Still worth £2 to get those deeds I think. If you need legal advice - go to the CAB - they should have a free solicitors rota and at the same time can feed all your details in to a program and see if you have any other entitlements re benefits. |

Now read the whole message. If the house is not in his name it will not be part of his estate. If it is in the joint names of himself and someone else it may not form part of his estate...depends whether he and the other person are joint tenants or tenants in common. I don't think you will be able to tell this from the Land Registry documents we're all telling you to get. If you are thinking about challenging his will or making a claim against his estate you should, if you haven't already, get some legal advice. Look in your local paper to see who gives a free first interview and go and have a chat. My first concern would be that if your children are now over 18 then any claim there might be may have been extinguished, but I understand how you feel. I still have to deal with the fallout from an absent father (who lives just down the road with very rich new wife) and my daughter is 23. Good luck Sheila Sheila |

Confirmed. £4 on your switch card will get you a copy of the Land or Charge Certificate and a copy of the title plan. Good luck Sheila |

If you go to the Land Registry site on line you can download any deeds for about £4 I think. (Actually its £2 for just part of the deeds - I just checked). I downloaded our neighbours from hell when he raised a boundary dispute. If it was bought since 2000 I believe you actually get the price it cost them too! Hi I need advice, How can I find out who a property is own by. My ex-husband has died and I understand that I can claim the 20yrs of maintenance that he didn,t pay from his estate, But if he didn't put his name on the deeds to the house would that be part of his estate or not. How far some people will go to exclude thier children beggers belief. Hoping for some advice. Best wishes. Pat |
