hubby getting sued for supposed injury.....

this no win no fee culture i feel is getting out of hand.like i said hubby had a crash which was his fault.the girl he crashed into was perfectly fine when she got out of the car ...now hubby has got a letter saying she is sueing for injury...he was only doing ten miles an hour and her car wasn't even that bad...this country is turning into the american culture where if you can squeeze a comp claim fake it!!xxxxxxxxxxxxxxxxxxxx)))):

We are becoming like the Americans with the whole sue everyone for nothing. Trouble with car crashes, you can not do anything to disprove whiplash, which I am pretty sure is what you will be being sued for. I used to manage a bar and I know for a fact people fake it and get thousands, a guy that came to the bar did it. It a disgrace!! Good Luck to your husband.

I think some people think that 'Oh well its only the insurance companies money' but they dont relise that we all end up paying, especially your hubby wjho no dounbt will have to pay higher premiums. Poor Hubby, sorry to hear of your troubles. Suzanne

my hubbys car was hit by another car but the person drove off and didn't leave a note on windscreen.my hubby had ti pay £200 excess.two weeks later he has a crash and has to pay another £200..thats £400 we have paid to the insurance companyin the past 4 weeks we're guttedxxxxxxxxxxxxxxxxxx)))):

Even m-i-l is getting phone calls from these companies asking her if etc. Hope hubby gets cleared, hopefully no doctor will sign her a certificate.

To be fair Lisa some injuries show themselves afterwards. I was a passenger in a car that hit another one a few years ago. Not very bad and the woman said she was fine at the time. But she suffered whiplash and wasn't aware of it at the time because of the shock - the whiplash led to back discomfort as well I believe. Ultimately if yr husband hadn't have hit her car, she wouldn't have been able to sue lol

sorry to hear whats happening to your hubby, whats wrong with the world, not so long ago when you had an accident a simple sorry sufficed and everyone went on their merry way, now as soon as you admit fault it opens the floodgates to all the money making voltures....eh hope you all arnt too stressed out over it, i've got a simple justice spell : say aloud and this will make all legal matters and when you've been wronged resolved....... 'keeper of what's just and right come and save me from this plight take swift action - hear my plea do now what i ask of thee' kaz

I sued once, when somebody hit my car from behind. I had whiplash and spent 4 hours at the hospital getting it diagnosed. I had also had a back operation a couple of years beforehand and my back had been fine until the accident and then it started playing up again. In my case my car was stationary and the idiot in the car behind was bending over the passenger side and looking at papers. I knew he was going to crash into me, but couldn't do anything about it. I 'braced' myself and that's probably why my injuries were worse than they should have been. To be quite honest, I didn't have any pain straight after the incident, but started to feel things about an hour later. I had to have a couple of days off work afterwards. This was the first time I had claimed anything on any of the insurances I have (apart from my pet insurance). So, while I agree that the 'sue for everything' culture in this country is getting ridiculous, I do think I had just reason in this case. AL

Last year I hit a deer - or rather the deer jumped a fence and landed on top of my car. My car was a right-off and I lost the excess of course, but the annoying thing is the accident was classed by the insurance company as my fault despite a police report saying what happened. I wasn't injured and didn't even go to hospital. However, I have lots of pain now and apparently it is whiplash. Can't sue the deer and they don't belong to anyone - unless of course you happen to go out and shoot one! I also hate this compensation culture we have adopted and the insurance companies aren't going to bear the losses - our policies will just increase. How many people have faked a house insurance claim?? I know I never have, but I also have seen it advocated many times - even on this site!

Lisa, I am sorry to hear what has happened to you hubby. My daughter was on the other side, she was hit by a driver who turned right from a left lane. There was very little damage to her car and she thought she was alright but later her muscles went into spasm, it was touch and go whether or not, they operated on her spine, She didn't work for nearly 3 years, you can imagine what a strain that put on finances. Then when she tried to get work, employers didn't want disabled. The other person's insurance company wouldn't accept liability so it went to court and the judge ruled that he was 100% to blame for the accident. She thought that she had won the case, the court ruled the amount to be paid,it wasn't as much as it cost her in loss of earnings. His insurance company made a token payment and she is still waiting for the rest. So, I dont believe what the media says. The girl may find that its not that easy to get compensation. I personally think, the insurance companies did have to tighten up, in the beginning, people were abusing the system but I think nowadays, it takes a lot more proving. I agree June. When I had my accident, I had to have a medical with an independent doctor and my medical records were obtained from both my GP and consultant. AL
