my son has been working for a company for approx 9 months.after 3 months he was put on permanent.the man who gives out the work[not the boss]has said he will be putting those on permanent back onto casual.my son is just going in for his first house,they,ve been given a mortgage based on my sons job.can this man do this.he does hire and fire,so i know he can set peeps on.but can he swop and change my sons job like that.xx

what sort of company is it? When they changed him to permanent did he have it in writing, and did they then give him a contract. I think it depends on all this. If he has a contract I don't think they can put him back. Is there a union in the company and does he belong to it. Ann Glos

just contacted him,he says he has signed a legal contract when they took him on full time. the man who im on about is not nice ,son says hes having an affair with someone while hes working away,and he does,nt come to the job sometimes coz hes with this woman.then he expects um to stretch the work out so this bloke can get an extra night with this woman.one man walked out today,its all hell there.he also said thank you for your kindness.xxx

I suggest Joy that he asks the CAB where he should go for advice. Is it possible that he could go over this person's head without causing a problem, and speak to somebody more senior? Ann Glos

hi anne yes the big boss,but it would cause too much trouble.and he feels it would cause him more trouble in the long term.xx

Theres no point worrying until it causes a problem. if it causes a mortgage prob or work dries up or he doesnt get his sick pay etc then he can see a solicitor/employment law specialist etc and he has a legal permanant contract so he doesnt need to worry. Effectively they would have to make him redundant then rehire him as a casual, which will see them end up in court before a tribrunial as you cannot make anyone redundant then take someone on to do the same job ( unless its been renamed/altered etc to the extent it cant be classed as the same job) Whilst i realise its unerving- he doesnt have a thing to worry about as he has his contract.

Joy as he has a pernement contract tell him not to accept a casual one now, and to seek advice A.S.A.P. just to cover his own back, if he leaves it, then it could be said that as he didn't take action straight away, so he has accepted the situation. I don't know the law, but I am a union rep, and that's the best advice I can give your son. Bev

Joy As your son has worked there for a relatively short time, unfortunately he has virtually no rights. There is also probably a probationary clause in his permanent contract (usually six months). I would suggest that he rings Acas but there is unlikely to be much that he can do about it. Best Wishes Andrea
